Terms of Service

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("Operator" or "User") and DoNotRent.com. By registering for an account, accessing, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy.

2. Description of Service

DoNotRent.com is a subscription-based platform that allows verified independent car rental operators to submit, search, and access reports about renters. The Platform is intended solely for legitimate vehicle rental businesses.

The Platform is NOT a consumer reporting agency as defined under the Fair Credit Reporting Act (FCRA).

3. Eligibility and Account Registration

• Be at least 18 years of age
• Operate a legitimate vehicle rental business
• Provide accurate, complete, and current registration information
• Maintain confidentiality of account credentials

4. Subscription Plans and Payment

• Free (Contributor): submit reports only
• Operator ($15/month): full search access plus report submission
• Fleet ($30/month): full search access, report submission, and API access

Subscriptions are billed monthly in advance. Payment processing is handled by Stripe and subject to Stripe terms.

5. Operator Obligations and Conduct

• Submit only truthful, accurate, good-faith reports based on direct experience
• Keep documentation or a factual basis supporting submitted reports
• Do not submit discriminatory, retaliatory, false, or fabricated reports
• Comply with all applicable federal, state, and local laws

6. Content and Reports

By submitting a report, you represent it is accurate to the best of your knowledge and that you are authorized to submit it. You grant DoNotRent.com a non-exclusive, worldwide, royalty-free license to store and display reports to verified subscribers.

Under 47 U.S.C. § 230, DoNotRent.com is an interactive computer service and is not the publisher or speaker of operator-submitted content.

7. Dispute Process

Individuals may dispute reports they believe are inaccurate or improperly submitted. We may request documentation and may annotate or remove reports where substantiation is inadequate.

8. Prohibited Uses

• No discrimination, retaliation, or harassment
• No scraping, reverse engineering, or unauthorized access attempts
• No account sharing or unlawful use of the Platform

9. Indemnification

You agree to indemnify and hold harmless DoNotRent.com and its affiliates from claims, damages, and expenses arising from your use, submitted reports, or legal violations.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) FEES PAID IN THE PRECEDING 12 MONTHS OR (B) $100.

12. Governing Law and Dispute Resolution

These Terms are governed by Florida law. Disputes are resolved by binding arbitration in Hillsborough County, Florida, except where equitable relief is sought.

YOU WAIVE RIGHTS TO JURY TRIAL AND CLASS ACTION PARTICIPATION.

13. Modifications to Terms

We may modify these Terms at any time. Continued use after changes become effective constitutes acceptance.

14. Termination

We may suspend or terminate access at any time. Surviving sections include content rights, indemnity, disclaimers, limitations, and dispute resolution.

15. Miscellaneous

These Terms and Privacy Policy are the full agreement regarding Platform use. If any provision is unenforceable, remaining provisions remain in effect.
